Kidzspace — Commercial Playground & Outdoor Fitness Equipment

This policy explains your rights and our process when you return Kidzspace playground or fitness equipment. It applies alongside — and never in place of — your rights under the Australian Consumer Law (ACL).
1. Your Rights Under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. These consumer guarantees are automatic and apply regardless of anything stated in this policy.
Under the ACL, goods you buy from us must:
- Be of acceptable quality — safe, durable, and free from defects.
- Match their description, sample, or demonstration model.
- Be fit for the purpose we represented or that you made known to us.
If a product fails to meet a consumer guarantee, you are entitled to a remedy:
- Major failure — you may choose a refund or a replacement, and compensation for any reasonably foreseeable loss.
- Minor failure — we will repair, replace, or refund within a reasonable time. The choice of remedy is ours for minor problems.
Where a fault is our responsibility, we cover the cost of returning large, heavy, or installed equipment. These rights apply whether equipment was purchased online, by quote, or on-site, and cannot be removed by any “no refund” term.
2. Change-of-Mind Returns (Voluntary)
Because most Kidzspace equipment is custom-designed, manufactured to order, and installed as a fixed-price project, change-of-mind returns are limited. Where a stock (non-custom) item is involved, we may accept a voluntary return on the following terms:
| Condition | Requirement |
|---|---|
| Timeframe | Within 30 days of delivery or collection. |
| Item state | Unused, unassembled, and in original packaging — resaleable condition. |
| Authorisation | A Return Merchandise Authorisation (RMA) must be obtained before sending anything back. Unauthorised returns are not accepted. |
| Restocking fee | Up to 20% of the item price may apply to change-of-mind returns. |
| Return freight | Paid by the customer for change-of-mind returns. Freight on bulky items can range from several hundred to over a thousand dollars. |
| Excluded items | Custom-built, made-to-order, and special-order equipment cannot be returned for change of mind. |
This voluntary section does not limit the consumer guarantees in Section 1, which always apply to faulty goods.
3. Council & Site Inspections
It is the customer’s responsibility to confirm that any equipment, spare part, or special-order item meets the requirements of their local council, certifier, or site-specific approval before purchase. Site conditions, planning rules, and inspection outcomes depend on factors outside our control.
Kidzspace is not responsible for, and will not accept change-of-mind returns or refunds arising from, a customer’s failure to obtain council approval or pass a local inspection. This exclusion does not apply where the equipment itself fails to meet a consumer guarantee or the Australian Standards we represented it as meeting (see Section 1).
We encourage customers to verify all council and planning requirements before ordering, particularly for spare parts and custom or special-order items.
4. Faulty, Damaged, or Incorrect Goods
Inspect on delivery
Please inspect your order at the time of delivery. Count all items and note any shortages or visible damage on the delivery receipt before signing for the consignment. Once a clear receipt is signed, claims for transit damage become significantly harder to pursue with the carrier.
Report promptly
Contact us within 48 hours of delivery if any item is faulty, damaged in transit, incorrect, or missing. Our team will assess the issue and arrange the appropriate remedy, including filing a freight claim on your behalf where relevant.
For faults covered by the consumer guarantees, you are not charged a restocking fee or return freight — we cover collection and return costs for large or installed equipment.
5. Manufacturer Warranty
Kidzspace equipment is manufactured to Australian Standards including AS 4685 (playground equipment safety) and, where surfacing is supplied, AS 4422. Each project is supplied with a manufacturer’s warranty covering defects in materials and workmanship under normal use.
The warranty is in addition to your consumer guarantees and does not replace or reduce them. Warranty cover excludes damage from misuse, vandalism, inadequate maintenance, unauthorised modification, or installation by parties other than Kidzspace or its approved installers.
6. How to Request a Return
- Contact our support team with your order or project reference and a description (and photos, where possible) of the issue.
- We will assess the request and, if approved, issue a Return Merchandise Authorisation (RMA).
- Package authorised returns securely with the RMA reference. Items must arrive in the agreed condition.
- Once received and inspected, we will process your remedy — repair, replacement, or refund as applicable.
Approved refunds are issued to the original payment method within a reasonable period after the returned goods are received and assessed.
